Sobre este esquema de controversia, la magistrada realizó una serie de reflexiones sobre el fenómeno del bullying y el modo en que ha sido aprehendido en la normativa internacional y doméstica, la cual impone diversas obligaciones a los establecimientos educativos tendientes a prevenir, detectar y, en su caso, superar la conflictividad social en las actividades educativas. Señaló que el art. 1767 del Código Civil y Comercial de la Nación impone una responsabilidad agravada del establecimiento educativo que solo admite como eximente el caso fortuito. A la luz de ese enfoque, indicó que el establecimiento educativo es responsable por acción u omisión.
