Incluso los jueces, de oficio, intervienen en este torneo y evitan con este mecanismo la necesidad de dirimir el caso…” Corresponde confirmar el rechazo del planteo de nulidad del dictamen fiscal por el que se dispuso habilitar la instancia de oficio, en los términos del art. 72, inc. 2º, último párrafo, CP., si se trata de una víctima menor de edad que contaba con diecisiete años al momento del hecho y del inicio de las actuaciones, sumada a las características del suceso, por lo que debe entenderse válida su voluntad expresada, en cuanto instó la acción penal, por sí misma, es decir, sin necesidad de acudir a la instancia de oficio prevista en el art. 72 in fine del CP, ante la negativa expresada por su madre.
