Consideró que en primer lugar debía pronunciarse sobre si el precedente mencionado debía ser mantenido o si existían razones de peso suficiente para justificar su abandono, teniendo en cuenta que el mismo se basaba en la convicción de que el dictado de la ley 24.285, aun en ausencia de un acto de ratificación por parte del Poder Ejecutivo, fue suficiente para que el Convenio OIT 173 se volviera plenamente vinculante en el ordenamiento jurídico argentino y adquiriese una jerarquía supralegal. Señaló que la ley aprobatoria de los tratados es solo una autorización para que el Poder Ejecutivo Nacional manifieste la intención de obligar internacionalmente a nuestra República a través de un tratado internacional y que sólo una vez que el tratado ha sido debidamente ratificado por éste y ha entrado en vigor en sede internacional sus disposiciones devienen vinculantes en el ámbito interno. Fundamentó “su reclamo en la afectación de sus derechos personalísimos al honor, el nombre, la imagen, la dignidad y la intimidad al haberla vinculado con páginas de Internet relacionadas con actividades pornográficas, oferta de sexo y similares, a través de la arbitraria inclusión de su nombre y apellido en sus resultados de exploración de sus buscadores web”.
