La reglamentación del BCRA introduce la Tasa de Intereses Moratorios (TIM), basada en un promedio entre tasas activas y pasivas del sistema financiero, con bandas de razonabilidad atadas al CER, lo que evita resultados confiscatorios o irrazonables. Aunque no deroga formalmente la legislación provincial, la TIM desplaza su eficacia normativa en virtud del principio de supremacía federal. En adelante, frente a obligaciones dinerarias sin tasa pactada ni ley especial válida, corresponde aplicar prioritariamente la TIM, garantizando uniformidad, previsibilidad y razonabilidad, y evitando distorsiones que afecten la seguridad jurídica de acreedores y deudores.
