El juez puntualizó que, si bien la municipalidad debe retirar los animales sueltos en pos de la seguridad del tránsito, para que nazca su responsabilidad civil en el caso concreto, tal deber debe ser entendido dentro de un contexto fáctico determinado, que evidencie que la presencia de tales animales es un hecho previsible o presumible. El magistrado agregó que la falta de servicio se configuraría si, frente a la presencia de un animal suelto, se efectúa la denuncia correspondiente y el municipio no cumple su obligación de retirar el animal. “Igualmente, se configuraría una falta de servicio si, frente a denuncias reiteradas sobre presencia de animales sueltos en determinada zona, la municipalidad no despliega una tarea de prevención particular”, añadió. En la sentencia, que todavía no está firme, el juez concluyó que la presencia del caballo en la calle debe considerarse un “hecho inesperado” para el municipio, puesto que no fue advertido previamente sobre la presencia del animal suelto; sino que se trató de un supuesto de irrupción repentina del equino en la vía pública.
