El artículo 768 establece un orden de prelación claro: lo pactado por las partes, las leyes especiales y, en su defecto, las tasas fijadas por reglamentación del Banco Central de la República Argentina (BCRA), delegación expresa que recién fue ejercida en enero de 2026 mediante la Resolución 1/2026. Durante más de una década, la ausencia de dicha reglamentación generó dispersión jurisprudencial y habilitó soluciones locales, como la Ley 9.041 de Mendoza y su modificación por la Ley 9.516, que fijaron tasas moratorias provinciales en un contexto de vacío operativo nacional. Sin embargo, estas normas se dictaron reconociendo su subordinación al régimen federal del art. 768 CCCN. La reglamentación del BCRA introduce la Tasa de Intereses Moratorios (TIM), basada en un promedio entre tasas activas y pasivas del sistema financiero, con bandas de razonabilidad atadas al CER, lo que evita resultados confiscatorios o irrazonables. Aunque no deroga formalmente la legislación provincial, la TIM desplaza su eficacia normativa en virtud del principio de supremacía federal. En adelante, frente a obligaciones dinerarias sin tasa pactada ni ley especial válida, corresponde aplicar prioritariamente la TIM, garantizando uniformidad, previsibilidad y razonabilidad, y evitando distorsiones que afecten la seguridad jurídica de acreedores y deudores.
