Sostuvo que diecisiete meses después la entidad comienza a reclamar una deuda que no tenía a través de mensajes de texto, email, WhatsApp y llamadas donde lo injurian, le exigen y lo extorsionan con el pago de algo inexistente e ilegal, todo lo cual le ocasionó consecuencias morales y económicas, a lo que debe agregarse la inclusión en la base de datos de morosos del Banco Central de la República Argentina y Veraz. Además, como consecuencia de ello, perdió la oportunidad de compra como inversión de un departamento en pozo, que luego sería revendido a la misma empresa constructora, lo que ya había realizado con anterioridad y nuevamente la iba a realizar el día 30 de mayo del año 2021, pero que la empresa constructora le rechazó la operación por encontrarse incluido en la base de datos de morosos. Reclamó daño emergente, daño moral, daño punitivo y aplicación del art. 208 del Código Procesal Civil, Comercial y Tributario de Mendoza. La accionada compareció al proceso y dio su versión de los hechos resistiendo la pretensión. La sentenciante aplicó el Código Civil y Comercial, como asimismo la Ley de Defensa del Consumidor, consideró acreditados los daños y admitió la demanda por la suma arriba referida. Al fundar su recurso manifiesta el mandatario judicial de la accionada que la sentencia está basada en consideraciones dogmáticas, alejadas de la realidad de los hechos y que se basa además en prueba notoriamente inválida, en afirmaciones carentes de fundamentación que ha colocado a su parte en estado de indefensión, tachándola de arbitraria por estar basada exclusivamente en la voluntad del magistrado de primera instancia. Refiere que al no estar dada de baja la tarjeta de crédito generó cargos que por estar impagos motivaron la radicación de la deuda en el sector recuperación crediticia del Banco y la derivación a Agencia para el intento extrajudicial de cobro, pero que el banco atento a que no había consumos y lo exiguo de la deuda, dio de baja a ésta y se lo informó al actor, que la sentencia sin ninguna fundamentación, interpreta esto como no cierto, que antes de la demanda no existía la deuda ni lo informaba como deudor el BCRA. Se resolvió que deberá revocarse parcialmente la sentencia de primera instancia, prosperando la demanda por la suma total de pesos un millón ciento veinte mil novecientos cincuenta ($1.120.950.-) y rechazarse por la suma de pesos novecientos treinta y seis mil ($ 936.000.-). En cuanto a las costas de primera instancia deberán ser a cargo de la accionada por lo que se admite la demanda y en el orden causado por lo que se rechaza el rubro lucro cesante, ya que estamos dentro del marco sustancial del consumo y considerando no sólo que el accionante tenía razones para litigar y buena fe, a lo que además debemos sumar su situación de persona vulnerable por su edad coincidiendo en tal apreciación con la jueza de grado. En tal sentido se ha dicho que “Las personas en riesgo de exclusión social, las que tienen una mayor falta de autonomía y, por tanto, un mayor grado de dependencia, suelen ser las más vulnerables y expuestas a abusos y posibles malos tratos tanto físicos como psicológicos. Entre ellas, de las más indefensas y con más factores de riesgo, se encuentran las personas mayores…” (Francisco Vanó Ferré, en la obra colectiva “Personas mayores vulnerables: maltrato y abuso”, voto de la Camarista Patricia Canela).
