El Juzgado de Familia de 6° Nominación de la ciudad de Córdoba resolvió extender la obligación alimentaria del padre de una adolescente a su actual esposa y la hizo responsable por su cumplimiento, en igual medida. Esta decisión se fundamentó en los reiterados incumplimientos del padre y en la importancia de garantizar el derecho alimentario de los niños, niñas y adolescentes (NNA). El progenitor venía incumpliendo la cuota desde el año 2016. El pedido de la madre se fundó en la solidaridad familiar y la figura del progenitor afín. El Código Civil y Comercial (CCC) reconoce ciertos derechos y obligaciones a los padres afines, es decir, aquellos que son pareja de sus progenitores biológicos. Entre ellos, el de contribuir a cubrir las necesidades de los hijos afines. Además, la normativa legal establece que las parejas casadas tienen el deber de aportar al sostenimiento de los hijos en común o de uno de ellos, con quienes convivan. La mujer demandada argumentó en su defensa que ella no cumplía el rol de madre afín, ya que no formaba parte de la crianza y educación de la adolescente, ni había compartido con ella momentos significativos de su vida. El tribunal le dio la razón en este punto a la esposa del progenitor. Sin embargo, señaló que eso no tornaba inválido el reclamo de la progenitora. Por el contrario, la jueza consideró que el principio de solidaridad familiar y la importancia del derecho alimentario de los NNA como derecho humano hacen procedente el pedido de alimentos. La cónyuge del padre también alegó que los deberes de asistencia familiar debían recaer principalmente sobre los parientes biológicos y agregó que su esposo tenía cinco hermanos. Pero este argumento fue rechazado, dado que se acreditó que los tíos paternos no se encontraban en buena situación económica e, incluso, algunos tenían a cargo a otros familiares. La jueza rechazó el pedido de nueva cuota a cargo de la cónyuge, por no ser madre afín. Sin embargo, basándose en la solidaridad familiar, el deber de contribución, el interés superior de los NNA y el artículo 553 del CCC, decidió hacerle extensiva la obligación por el pago de la cuota alimentaria que ya estaba fijada respecto del progenitor. Fundamentos del fallo No se tuvo en cuenta que el llamado a indagatoria procede cuando hubiere motivo bastante para sospechar que una persona ha participado en un delito, que es un acto de impulso del proceso e interrumpe la prescripción. No resulta correcto buscar una justificación del acto apelado bajo el ropaje del derecho del menor a ser oído.
