El caso surge con motivo de la publicidad ilícita, conforme indica el Código Procesal para las Relaciones de Consumo en la CABA, promovida por los abogados Facundo J. Roitman y Melisa E. Guevara contra Cruiseline S.R.L., quienes pidieron que se le ordene el cese de las publicidades en las que promociona viajes en crucero anunciando que el territorio de las Islas Malvinas es perteneciente al Reino Unido. Asimismo, solicitaron la baja preventiva de la publicidad y la publicación de anuncios rectificatorios en las mismas condiciones en que fue realizada la oferta, como así también, la publicación de la sentencia condenatoria en los sitios de internet, cuentas de redes sociales de la demandada y digitalmente en los diarios de circulación local y nacional. También, pidieron la remisión de una copia de la sentencia condenatoria a cada consumidor que haya contratado o contrate en el futuro el crucero. El magistrado consideró que las publicidades en cuestión son ilícitas y pueden catalogarse como engañosas, en virtud de que contienen ocultamientos e inexactitudes, “que tienen entidad suficiente para inducir a error, confusión o engaño a los consumidores que pretenden contratar el crucero, en donde no se les brinda información correcta sobre los países que visitaran durante el viaje, sobre la ubicación geográfica de los destinos turísticos y se incluyen imágenes fotográficas de ciudades que el crucero no visitara”. Por ello, el juez le ordenó a la empresa que, en el plazo de 5 días, elimine los aspectos ilícitos de los mensajes publicitarios y proceda a la rectificación de toda publicidad ilícita. También dispuso que en toda publicación futura en donde se oferte un viaje con escala en las Islas Malvinas, las Islas Georgias o a las Islas Sandwich del Sur, se indique como país de destino la República Argentina.
