Señaló que ante la claridad en la falta de operatividad del DJA por estar sujeto a un procedimiento necesario e inconcluso no se configuraba un “caso” en que se verifique un estado de “incertidumbre” sobre la existencia, alcance o modalidad de una relación jurídica que pudiera producir un perjuicio o lesión actual a la actora sino que la acción deducida tendía a obtener una declaración general y directa sobre la existencia o no de un régimen jurídico general del servicio público de transporte de pasajeros, lo que no constituía un “caso contencioso” o “causa” que justificara la intervención del órgano judicial.
