La Sala Penal del Tribunal Superior de Justicia de Córdoba (TSJ) hizo lugar a un recurso de queja y a un recurso de casación planteados por la defensa de un imputado; y anuló la decisión de la Cámara en lo Criminal y Correccional de Cruz del Eje que había declarado la nulidad de sus declaraciones indagatorias.
En la etapa previa al juicio, la cámara había declarado la nulidad de dos declaraciones del imputado prestadas durante la investigación preparatoria (en una se abstuvo de declarar y en otra prestó testimonio) y también los actos posteriores que sean su consecuencia directa; esto, por considerar que aquellas habían sido realizadas sin adecuada asistencia técnica, ya que solo había intervenido la Auxiliar Colaboradora de la Defensa Pública y no existía constancia expresa de la estrategia defensiva definida por la defensora.
Frente a ello, la defensa cuestionó dicha decisión por entender que la actuación del Auxiliar Colaborador es válida conforme a la normativa vigente, que permite su intervención en actos procesales bajo la supervisión del Defensor Público, sin exigir la presencia física de este último ni la explicitación de la estrategia adoptada. Consideró, en primer término, que la cámara denegó indebidamente el recurso de casación, al no advertir que la resolución impugnada generaba un gravamen irreparable, en tanto afectaba no solo el derecho de defensa del imputado sino también el adecuado funcionamiento del sistema de defensa pública. El tribunal sostuvo –con cita de las disposiciones legales pertinentes– que las declaraciones del imputado son válidas cuando interviene un Auxiliar Colaborador de la Defensa Pública, en tanto actúa por disposición y bajo la responsabilidad del Defensor Público.

El Tribunal resolvió revocar la sentencia que ordenó a un buscador de contenidos en la Internet el bloqueo definitivo de los enlaces que hacían referencia a una causa penal en la cual un abogado fue condenado por estafa contra una clienta, en la que posteriormente resultó absuelto, dado que el contenido de los sitios denunciados por el actor tienen relación con noticias de relevancia pública y no existe el derecho a privar de manera indiscriminada a toda la comunidad de la posibilidad del acceso irrestricto a los contenidos publicados, a pesar de que hayan transcurrido varios años.
El derecho al olvido no es un derecho ilimitado y la decisión de la desvinculación de los enlaces que un buscador realiza entre el nombre de una persona y los sitios que alojan información que la mencionan no puede quedar librada exclusivamente a la voluntad del sujeto afectado, pues tal solución privilegiaría los derechos del afectado respecto de otros (información y libertad de expresión). Las cuestiones de interés público constituyen el límite del derecho al olvido.

Las Jornadas Nacionales de Derecho Civil se realizan, desde hace más de medio siglo, en diferentes sedes universitarias de la Argentina. Las primeras se llevaron a cabo en Santa Fe en el año 1963, a instancias del Instituto de Derecho Civil de la Facultad de Ciencias Jurídicas y Sociales de la Universidad Nacional del Litoral. Posteriormente, se reiteraron cada dos años en forma prácticamente ininterrumpida.
El análisis de los temas abordados y las conclusiones alcanzadas en cada una de sus ediciones anteriores da cuenta de una importancia y trascendencia que excede el mero ámbito académico, en tanto han tenido, y continúan teniendo, clara influencia sobre nuestra legislación.
En septiembre del año 2017 el Consejo Directivo de las Jornadas encomendó la organización de las XXVIII a la Universidad Nacional de Cuyo y la Universidad de Mendoza. Esta edición tuvo como autoridades honorarias a Aída Kemelmajer de Carlucci como presidenta y Carlos Alberto Parellada como vicepresidente, dos reconocidos juristas y docentes del Derecho Civil provincia, nacional e internacional.
