Se agrava la apelante por entender que anular el testamento por la falta de fecha es un exceso de rigor formal ya que no existe un argumento de fondo en relación con la misma que se haya planteado por los herederos para justificar la nulidad. Agrega que la exigencia de la fecha se hace necesaria por dos motivos: a) como el testamento posterior revoca al anterior, es indispensable saber cuál de los dos ha de prevalecer; b) por la fecha se puede decidir si el testador era capaz o no al momento de redactarlo. Concluye que, dado que ninguna de estas dos cuestiones se da en el caso planteado en autos, no se observa fundamento para la nulidad. Señala que se debe dar preeminencia a la voluntad de la causante. Agrega que el papel utilizado por ambos causantes pertenece a un cuaderno de hojas numeradas y el testamento otorgado por el causante Nicolás Dolce (que sí contiene fecha) fue redactado en la hoja nº 99, en tanto que el testamento otorgado por la causante Josefina Álvarez Pérez fue redactado en la hoja nº 97, por lo que se puede inferir la fecha. Propone que, de considerarse necesario, se podría disponer pericia en la tinta para determinar la antigüedad de esta. Respecto a la base normativa, se ha flexibilizado el régimen, puesto que ya no se exige una fecha “precisa” (art. 3642, C.C.), sino “cierta” (art. 2477, CCCN). Bajo la vigencia del Código Civil se había considerado que la exigencia formal de enunciar inexcusablemente la fecha con sus tres componentes (día, mes, año) dimana claramente de los arts. 3639 y 3642 del Código Civil, lo cual no puede sostenerse a partir de la vigencia del CCCN que permite tenerla por cumplida a través de “enunciaciones o elementos materiales que permitan establecer la fecha de una manera cierta” y ha eliminado el contenido del art. 3642 precitado. De la literalidad del segundo párrafo del artículo 2477 del CCCN surge que la falta de fecha no invalida el acto si del propio testamento emerge algún dato que permita determinarla. Esto ya implica un pronunciamiento del CCCN respecto que la fecha no es un elemento ad solemnitatem (…). Por ello, la Cámara Segunda Civil y Comercial (Sala I) de La Plata resolvió hacer lugar al recurso de apelación y revocar la nulidad del testamento ológrafo, determinando que su fecha es anterior a la del testamento ológrafo del causante y la ley aplicable es el Código Civil y Comercial de la Nación.
