A su vez, solicitaron la declaración de inconstitucionalidad del artículo 5° –incisos a, e y dos últimos párrafos– y del artículo 14 –segundo párrafo– de la ley 23.737, así como de toda otra norma que prohibiera el autocultivo para consumo medicinal de los menores de edad a su cargo. Ante el rechazo de la acción en primera y segunda instancia recurrieron a la Corte que, finalmente, confirmó la sentencia de cámara. En primer lugar, señaló que el dictado de nuevas normas posteriores al planteo había convertido en inoficioso pronunciarse sobre la primera de las cuestiones. En cambio, quedaba pendiente de decisión si el ámbito de autonomía individual que protege el artículo 19 de la Constitución Nacional impide al Estado Nacional controlar y autorizar el autocultivo de cannabis con fines medicinales. El Tribunal señaló que la autoridad del Estado para controlar en general a los productos usados con fines medicinales se justifica en el propósito de asegurar que sean efectivamente administrados en un tratamiento médico en el que se evalúe el riesgo o consecuencias adversas que pueden generar para la salud, y agregó que la Constitución Nacional no solo permite, sino que obliga a las autoridades públicas a adoptar medidas y políticas tendientes a proteger la salud de la población. Por otra parte, tuvo en cuenta que los beneficios y la eficacia del tratamiento cannábico no significan que esté exento de riesgos o de efectos adversos. Concluyó que la necesidad del Estado de articular dos potestades -permitir el uso medicinal del cannabis y perseguir el tráfico ilícito de estupefacientes- justifica el control estatal del autocultivo medicinal, y que las razones de salud y seguridad públicas involucradas resultan suficientes para justificar que se expidan autorizaciones administrativas para ello. La Corte consideró que las medidas de control estatal constituyen una injerencia mínima que, lejos de proscribir el autocultivo con fines medicinales, lo someten a una regulación que se limita a asegurar cierta supervisión por parte del Estado y aclaró que lo decidido resultaba compatible con lo decidido en “Arriola” (Fallos: 332:1963) en tanto dicho precedente no inhibe la posibilidad de que el Estado ejerza un control administrativo sobre el cultivo de cannabis.
