Sostuvo que la falta de contestación de demanda determinaba que se debía presumir la veracidad de los hechos. La Sala referida observó que el trabajador no cumplió con la intimación exigida por el art. 1 del decreto 146/2001. Al respecto, las magistradas señalaron que no cabía tener por satisfecho dicho requisito formal toda vez que en la comunicación enviada por la actora a la demandada en ningún momento intimó de manera fehaciente a la demandada para que en el plazo de 30 días procediera a ingresar los aportes adeudados. La reclamante únicamente se limitó a transcribir el art. 132 bis LCT para considerar procedente la imposición de la sanción en análisis, pero con ello "no puede concluirse válidamente que haya sido invocado concretamente el presupuesto fáctico exigido por la norma, esto es que la demandada haya retenido aportes y no los haya ingresado a los organismos de la seguridad social pertinentes".
