La Cámara Nacional de Apelaciones en lo Contencioso Administrativo Federal confirmó la multa impuesta al Dr. F. A. P. por haber infringido los arts. 6, inciso e) de la ley 23.187 y 6, 10 inciso a) y 19 incisos a) y f) del Código de Ética.
Se denunció al mismo por haber abandonado su actuación en la causa sin haber concluido la tarea encomendada. El Tribunal de Disciplina consideró que "hubo inactividad profesional de parte del abogado denunciado que generó la declaración de caducidad de la instancia", y que "la omisión incurrida implicó no haber atendido con “celo, saber y dedicación” los intereses confiados".
Para la cámara, existió inactividad profesional del abogado interviniente, quien no impulsó la causa para la cual fue contratado. Específicamente, "no existió actividad procesal de carácter impulsor de parte de los profesionales que patrocinaban los intereses de los actores en la referida causa".
Se confirmó la sentencia dictada por la Sala III del Tribunal de Disciplina del Colegio Público de Abogados de la Capital Federal.

El fallo destacó que el propio interesado debe prever su resguardo.
El peticionario requirió como prueba anticipada que se certifique acerca de la existencia del grupo de mensajería instantánea del consorcio, sus integrantes, los números respectivos, administradores, autenticidad y contenido de los mensajes existentes en el grupo, relacionados una asamblea, su orden del día, las decisiones adoptadas y sus efectos.
El caso llegó a la Sala I de la Cámara Civil. Los magistrados recordaron que la ejecución de prueba fuera del proceso “es de excepción” y de “interpretación estricta”, por lo que su admisibilidad “requiere la demostración de los motivos justificados para temer que su producción pueda resultar imposible o muy dificultosa en el período de prueba”
