Consideró que la actora había vulnerado el principio de congruencia al sostener que se encontraba como peatón cuando, en realidad, habría estado sobre una motocicleta, y atribuyó especial relevancia causal a la circunstancia de que carecía de licencia para conducir por ser menor de edad. La Corte Suprema dejó sin efecto esa decisión por arbitraria. Señaló que la cámara se apartó de las constancias de la causa, ya que en la demanda la actora solo había afirmado haber sido embestida por el automóvil de la demandada, sin precisar si se encontraba a pie o sobre una motocicleta. Asimismo, destacó que tampoco existían pruebas suficientes para concluir que estuviera conduciendo el rodado al momento del accidente. Finalmente, sostuvo que la sentencia apelada no explicó de qué manera la falta de licencia de conducir había incidido en la producción del hecho ni por qué esa circunstancia configuraría un hecho de la víctima apto para eximir totalmente de responsabilidad a la demandada, en los términos del artículo 1729 del Código Civil y Comercial. Por ello, ordenó dictar un nuevo pronunciamiento debidamente fundado.
