Esta última interpuso recurso de apelación y sostuvo que el monto indemnizatorio se había calculado apartándose de lo dispuesto en el artículo 12 de la ley 24.557 conforme a la nueva redacción establecida en la ley 27.348. La cámara consideró que la condena no sólo resultaba insuficiente, sino que violentaba normas de orden público y la modificó, aún cuando la parte actora no había formulado planteo concreto al respecto. Ante la interposición de un recurso extraordinario por parte de la demandada, la Corte revocó la sentencia apelada. Expresó que se había incurrido en una reformatio in pejus, vulnerando así en forma directa e inmediata el derecho de propiedad y la garantía de defensa en juicio. Efectivamente, la alzada había colocado a la única apelante en una peor situación que la resultante del pronunciamiento de primera instancia, violando así el límite de su competencia, circunscripto a las cuestiones controvertidas.
