El caso se originó a partir de una acción de amparo iniciada en 2017 por una paciente con fibrosis quística, quien solicitó la cobertura de la terapia triple moduladora compuesta por elexacaftor, tezacaftor e ivacaftor, comercializada en el exterior bajo la marca Trikafta. Durante el proceso, OSDE ofreció sustituir el medicamento importado por Trixacar, de fabricación nacional, autorizado por la ANMAT y con los mismos principios activos, propuesta que fue rechazada por las instancias inferiores. La Corte recordó que la Ley 27.552 garantiza la cobertura integral de los medicamentos indicados para la fibrosis quística, pero destacó que el Poder Ejecutivo vetó la disposición que impedía sustituir la medicación prescripta por el profesional tratante. Asimismo, señaló que la normativa reglamentaria contempla la intervención de la autoridad sanitaria para definir las condiciones y alcances de la cobertura, y que la terapia triple moduladora integra la canasta oficial de medicamentos aprobada para esta patología. El Tribunal precisó que la controversia no versaba sobre la necesidad de brindar la terapia triple moduladora ni sobre la obligación de OSDE de cubrirla íntegramente, sino exclusivamente sobre si la cobertura debía recaer necesariamente sobre el medicamento importado cuando existía un producto nacional autorizado por la ANMAT con igual composición. Para la Corte, la sentencia de Cámara efectuó una valoración parcial de la prueba. En particular, observó que el dictamen del Cuerpo Médico Forense no concluyó que Trikafta fuera el único tratamiento posible, sino que expresó que no existía contraindicación para sustituirlo por Trixacar. También destacó que el tribunal omitió considerar que la actora no respondió el requerimiento destinado a justificar la imposibilidad de reemplazar la medicación ni a informar los resultados obtenidos durante el período en que recibió el medicamento nacional. Asimismo, el Máximo Tribunal consideró infundado el argumento relativo a la falta de estudios de bioequivalencia entre ambos medicamentos, al señalar que tal exigencia no surgía de la normativa vigente ni era requerida por la ANMAT para los principios activos involucrados, organismo que posee la competencia específica para autorizar y fiscalizar medicamentos en el país. En consecuencia, la Corte hizo lugar al recurso extraordinario de OSDE, dejó sin efecto la sentencia apelada y ordenó que el tribunal de origen dicte un nuevo pronunciamiento conforme a las pautas establecidas en el fallo. Consideró que la actora había vulnerado el principio de congruencia al sostener que se encontraba como peatón cuando, en realidad, habría estado sobre una motocicleta, y atribuyó especial relevancia causal a la circunstancia de que carecía de licencia para conducir por ser menor de edad. La Corte Suprema dejó sin efecto esa decisión por arbitraria. La empresa desistió de la operación y demandó al banco por considerarlo responsable de que se hubiera frustrado el negocio, reclamándole los daños y perjuicios que dijo haber sufrido y la cámara hizo lugar al reclamo.
