Sin embargo, el Tribunal descartó tales argumentos reiterando criterios ya establecidos en precedentes análogos. Señaló que —aun antes de la Comunicación B 10.925/2014, que prohibió expresamente el cargo— ya resultaba ilícito cobrar sumas adicionales no vinculadas a un servicio concreto, en virtud de la Comunicación A 3052 y los principios generales que impiden el enriquecimiento sin causa (arts. 1794 y 1796 CCCN). La Cámara destacó que el banco no demostró haber brindado ningún servicio adicional para habilitar consumos por encima del límite fijado, ni acreditó costos reales asociados al supuesto “riesgo”. Subrayó que permitir el exceso dependía únicamente de la decisión unilateral del propio banco, sin beneficio cierto para el usuario, quien solo asumía mayor endeudamiento. Asimismo, verificó que la entidad incumplió el deber de información, dado que no aportó documentación que indicara con claridad la existencia del cargo, su costo ni los parámetros para autorizar excesos. Finalmente, la Cámara rechazó el recurso del banco, confirmó la condena y mantuvo la obligación de restitución, al concluir que el cargo era ilegal, carecía de causa y configuraba un incremento prohibido del costo financiero.
