Señaló que la ley aprobatoria de los tratados es solo una autorización para que el Poder Ejecutivo Nacional manifieste la intención de obligar internacionalmente a nuestra República a través de un tratado internacional y que sólo una vez que el tratado ha sido debidamente ratificado por éste y ha entrado en vigor en sede internacional sus disposiciones devienen vinculantes en el ámbito interno. La Corte señaló que, más allá de que la pretensión se funde en normas que, como la ley 24.240, integran el derecho común, lo medular de la cuestión planteada exige esencial e ineludiblemente interpretar el sentido y los alcances de la ley 27.442 de naturaleza federal y cuyo conocimiento está reservado a la justicia de excepción y excluido de la competencia de los tribunales locales.
