Su pretensión se basa en el boleto de compraventa que, con fecha 07 de abril de 1975, suscribió en calidad de compradora con el demandado en carácter de vendedor. Sostuvo que el pago se convino en cuotas mensuales, cuya escrituración sería realizada una vez abonada la totalidad de estas. Alegó que las cuotas fueron abonadas en su totalidad, pero la escritura traslativa de dominio no fue cumplimentada por el vendedor y que es poseedora de buena fe del inmueble. Existe a su favor la obligación de escriturar por parte del vendedor, quien figura como propietario en el Registro de la Propiedad Inmueble, toda vez que desde el 21 de marzo de 1977 la obligación se hizo exigible, por haber cancelado el saldo del precio de la operación de compra del terreno. Adujo tener la posesión desde el año 1975, habiendo construido su vivienda en el terreno, morando allí desde aquel entonces, de forma pública, pacífica e ininterrumpida, con ánimo de dueña. La acción de prescripción se tuvo por promovida contra el titular registral del inmueble y/o quien resulte propietario. Luego de producidas las pruebas y puestos los autos para alegar, se ordenó citar en carácter de tercero a la empresa.- apelante-, quien invocó a su favor derecho de propiedad sobre el inmueble objeto de autos, por haberlo adquirido en pública subasta La sentencia de grado hizo lugar a la demanda declarando en favor de la actora la adquisición del dominio por posesión veinteñal del inmueble con costas a la demandada; pero esa decisión motivó un recurso interpuesto donde expresaba que su parte tenía derecho legítimo sobre el inmueble por adquirirlo en la subasta, y sin embargo se estaba reconociendo un mejor derecho a la actora, cuando su parte reclamó que el plazo requerido en la acción de usucapión fue interrumpido por los actos del proceso de ejecución de sentencia donde se subastó el lugar. Remarcó que habían pasado 10 años desde la toma de posesión por el martillero de la subasta para que la actora recién inicie la prescripción, ya están en conocimiento directo del trámite ejecutorio, consintiendo la subasta sin reclamar nada oportunamente, ya que el incidente de nulidad de remate que inició fue realizado con posterioridad a la misma y se cerró por caducidad de instancia. La Sala Cuarta de la Cámara de Apelaciones en lo Civil y Comercial de Resistencia, Provincia del Chaco, confirmó la sentencia con costas.
