Para decidir de este modo rechazó el planteo de inconstitucionalidad del aludido art. 132 bis LCT. Contra tal decisión, la demandada dedujo el recurso extraordinario federal y la queja. La Corte revocó la sentencia apelada y declaró, para el caso, la inconstitucionalidad del art. 132 bis de la LCT. A tal fin, expresó que resulta requisito para la validez de una norma legal el de su razonabilidad, sin que quepa a los jueces arrogarse facultades para decidir sobre el mérito ni sobre la conveniencia del criterio adoptado por el legislador, en cuanto lo cuestionado al respecto no revista jerarquía constitucional. Que la irrazonabilidad de la aplicación a este caso concreto de la norma cuestionada – sostuvo el Tribunal - queda puesta de manifiesto, sin más, por la evidente falta de proporcionalidad entre la sanción y su finalidad de prevención o punición de la evasión fiscal, a poco que se repare en que por una deuda que ascendía a $ 11.406,21, se impuso una multa de $ 194.775, equivalente a 53 salarios mensuales de la actora y ello en el marco de una relación laboral que duró un año y ocho meses, desentendiéndose así el fallo de la realidad económica subyacente en la causa. Por lo demás, sostuvo la Corte, la aludida falta de proporcionalidad obedecía a la ausencia de previsión legal que posibilitase la graduación de la multa, tal como sí se preveía en otras leyes laborales que establecían agravamientos indemnizatorios (v.gr. art. 16 de la ley 24.013 o art. 2° de la ley 25.323), circunstancia a la que se suma la inexistencia de todo tope.
