Description An account of the resource Son numerosas las acciones que se interponen ante los tribunales del país con el fin de obtener la readecuación de los contratos por los cuales se adquieren vehículos bajo la modalidad denominada “ahorro para fines determinados” o “plan de ahorros”. A partir de abril del año 2018, los valores móviles de los rodados que se pueden adquirir bajo esta modalidad contractual se dispararon, y los suscriptores comenzaron a recibir cuotas que superaban sus ingresos. Por ello, la mayoría de esas acciones son encuadradas en la llamada “Teoría de la Imprevisión”, porque se trata de un hecho imprevisible ajeno a los contratantes, que exige interpretar las circunstancias del caso a la luz del instituto jurídico regulado en el art. 1091 del Código Civil y Comercial de la Nación (CCCN). En este artículo, las autoras analizan la posibilidad de plantear Acciones de Simulación con el objeto de solicitar que se disponga la nulidad del Contrato de Plan de Ahorros, convirtiendo el mismo en el contrato que responde a la realidad del acuerdo celebrado, es decir, una financiación tradicional. Concluyen que, en la actualidad, la conformación de estos grupos de ahorro se ha trasformado en un verdadero acto simulado, que posibilita tanto a fábricas automotrices como a empresas administradoras de planes de ahorro (y quizás incluso a concesionarias), aplicar un sistema de financiamiento a la compra de rodados, de modo tal de ocultar con ello la violación de múltiples normas de carácter legal (incluso muchas de ellas de orden público), así como de eludir los controles que realiza el BCRA en materia financiera.
