En el voto que lideró el acuerdo, la Corte se remite a los fallos “Rodríguez, María Belén” y “Gimbutas, Carolina Valeria”, donde el máximo tribunal sostuvo que los buscadores de internet son meros intermediarios que se limitan a mostrar contenidos ajenos (exhibidos en otras páginas web) y que su responsabilidad surge –en supuestos excepcionales- cuando no actuaran diligentemente a partir del efectivo conocimiento de la ilicitud de dichos contenidos. Así, en base al reconocimiento constitucional y convencional del derecho a la imagen y la dignidad de las personas, y lo establecido en el artículo 53 del Código Civil y Comercial respecto a la captación y reproducción de la imagen de las personas, el voto disidente concluyó que “se han utilizado fotografías de la actora sin su consentimiento expreso o tácito, circunstancia que configura una invasión ilegítima a su esfera íntima que debe ser reparada”.
