La magistrada de grado expresó "no tendrá favorable andamiaje la sanción prevista en el art. 132 bis LCT, toda vez que la pretensora no acreditó el presupuesto de admisibilidad material previsto en la norma; esto es la retención de aportes y su no destino a los Organismos de la Seguridad Social", y que "una sanción conminatoria que tiene como presupuesto de viabilidad una retención indebida de recursos de la seguridad previamente descontados al trabajador, importa un ilícito (art. 43 ley 25.345 y art. 9 ley 24.769), y, por ende, no se encuentra alcanzada por la presunción de marras (art. 71 LO)". El actor cuestionó dicha decisión porque, a su entender, la presunción del art. 71 de la L.O. "sólo se desvirtúa por prueba en contrario y esta última situación no fue producida en autos por la demandada". Sostuvo que la falta de contestación de demanda determinaba que se debía presumir la veracidad de los hechos. La Sala referida observó que el trabajador no cumplió con la intimación exigida por el art. 1 del decreto 146/2001. Al respecto, las magistradas señalaron que no cabía tener por satisfecho dicho requisito formal toda vez que en la comunicación enviada por la actora a la demandada en ningún momento intimó de manera fehaciente a la demandada para que en el plazo de 30 días procediera a ingresar los aportes adeudados. La reclamante únicamente se limitó a transcribir el art. 132 bis LCT para considerar procedente la imposición de la sanción en análisis, pero con ello "no puede concluirse válidamente que haya sido invocado concretamente el presupuesto fáctico exigido por la norma, esto es que la demandada haya retenido aportes y no los haya ingresado a los organismos de la seguridad social pertinentes". Asimismo, se desarrollan los criterios de aplicación de la nueva tabla, los topes máximos de incapacidad y las reglas generales previstas para los distintos sistemas y regiones anatómicas. El trabajo adopta un enfoque descriptivo-analítico, orientado a brindar una lectura ordenada y accesible del nuevo baremo, sin perjuicio de incorporar una mirada crítica respecto de las tensiones que la mayor estandarización del daño puede generar frente al principio de reparación integral. En este sentido, se destaca el impacto que la reforma puede tener tanto en la práctica pericial como en la litigación judicial, ofreciendo herramientas conceptuales para comprender el alcance y las implicancias del Decreto 549/2025 desde su entrada en vigencia.
