La Sala VI de la Cámara Nacional de Apelaciones del Trabajo resaltó que la manda legal "obliga a fijar un resarcimiento por daños y perjuicios que, por lo general y en la práctica judicial, suele ser equivalente a los salarios que el trabajador hubiera debido cobrar durante el período en que se había comprometido a trabajar", pero destacó que "los francos compensatorios como las vacaciones estipuladas por el art. 156 de la LCT no tienen carácter retributivo pues son compensaciones patrimoniales por haber prestado servicios efectivos y no se discute que, después del 31 de enero, el actor fue dueño absoluto de su fuerza de trabajo y, en consecuencia, el argumento esgrimido no legitima un derecho al incremento de la reparación tradicional en la materia". La Cámara consideró correcto lo que se afirmó en materia del rubro aguinaldo toda vez que "de haber trabajado el actor durante el período en disputa, hubiera cobrado dicho adicional por cada día trabajado". Por ello, únicamente se elevó el monto indemnizatorio por daños y perjuicios.
