C., L. L. M. y otro s/Ejecución de alquileres", a la Sala D de la Cámara Nacional de Apelaciones en lo Civil a los fines de resolver el recurso deducido por el ejecutado contra la resolución que rechazó la excepción de pago total interpuesta por él y la garante con motivo de la ejecución de alquileres promovida. Los camaristas recordaron que el art. 865 del CCCN establece que el pago es "el cumplimiento de la prestación que constituye el objeto de la obligación. Sus principales efectos son la extinción del crédito y la liberación del deudor". A los fines de la excepción de pago, "éste debe resultar de los propios documentos, sin necesidad de otras investigaciones, dada la limitación de conocimiento a las formas extrínsecas que rigen en el juicio ejecutivo". Sumado a ello, es requisito que el pago sea documentado y extendido con indicación precisa y detallada de la deuda que se cancela. En dicho marco, los magistrados resaltaron que en el caso en análisis, inicialmente se reclamaron los cánones locativos correspondientes a agosto y septiembre 2018, ampliándose luego la demanda ejecutiva. En cuanto a los recibos con los cuales se pretendía sustentar la excepción de pago, eran de fecha 10/01/21019 y 11/01/2019. Lo cierto, es que para dar sustento a la excepción de pago, el mismo, además de los requisitos ya mencionados, debe ser "anterior a la interpelación judicial, no pudieron ser invocado eficazmente el efectuado a posteriori".
