Por último, la magistrada remarcó que resulta la imperiosa necesidad de una ley nacional que disponga la renegociación de los contratos para créditos hipotecarios UVA, a fin de brindar soluciones de fondo a todas las familias con estos créditos. ¿Por qué se retrotrajo la deuda a agosto de 2019? Según la magistrada, en esa fecha el Poder Ejecutivo nacional decretó el congelamiento de las cuotas de los créditos hipotecarios UVA y UVI hasta diciembre del mismo año reconociendo de esta forma que el sistema se encontraba en crisis. Recordemos que el tomador había solicitado un crédito hipotecario para refacción de su vivienda por $1.200.000 y por un plazo de 15 años, a la fecha debía más de $7 millones y por aplicación del fallo, la deuda debe recalcularse y retrotraerse al mes de agosto de 2019 cuando debía $2.600.000. Con respecto al Banco Nación, la justicia Federal de Mendoza ha hecho lugar a numerosas medidas cautelares que ordenan al banco adecuar los montos de las cuotas, que no pueden superar el 30% de los ingresos de los deudores hipotecarios. La Cámara Federal de Mendoza confirmó dichas medidas ordenando además de renegociar los contratos eliminando el UVA.
