Description An account of the resource La autora realiza un recorrido por la legislación internacional, nacional y provincial que regula la figura del abogado del niño. Comienza con la Declaración de Ginebra de 1924, texto histórico que reconoce y afirma, por primera vez, la existencia de derechos para los niños y las niñas. Luego, hace referencia a la Convención Americana sobre Derechos Humanos que establece que toda persona tiene derecho a ser oída y de ser asistido por un defensor proporcionado por el Estado. En efecto, en 1990 Argentina ratifica la Convención sobre los Derechos del Niño, por ley 23.849, a la cual se le otorga jerarquía constitucional en 1994 conforme el artículo 75 inc. 22 de la Constitución Nacional. En el año 2005 se sanciona la ley 26.061, que prevé el derecho a ser asistido por un letrado preferentemente especializado en niñez y adolescencia. Con la sanción del Código Civil y Comercial de la Nación Argentina en 2015, se establece que: “La persona menor de edad que cuenta con edad y grado de madurez suficiente puede ejercer por sí los actos que le son permitidos por el ordenamiento jurídico. En situaciones de conflicto de intereses con sus representantes legales, puede intervenir con asistencia letrada”. En la Provincia de Mendoza, la ley 6.354 regula el Régimen Jurídico de la protección de minoridad. En el año 2017, el Código Procesal, Civil, Comercial y Tributario de la Provincia de Mendoza enuncia que: “Las niñas, niños y adolescentes que cuenten con edad y grado de madurez suficiente podrán solicitar al/la Juez/a la designación de un/a abogado/a”.
