Asimismo, condenó a tres empresas porque entendió que quienes habían presidido o integrado el directorio de una de ellas también eran solidariamente responsables. La Corte Suprema de Justicia de la Nación revocó este pronunciamiento con invocación de la doctrina de la arbitrariedad. Para resolver así la CSJN consideró que el tribunal partió de la premisa de que los directores codemandados tuvieron una participación directa en la gestión de los negocios que dieron lugar a la contratación del demandante a través de otras empresas, pues sostuvo que “han obrado con pleno conocimiento de la naturaleza de la relación” y “con la deliberada intención de no registrar el vínculo con el actor” acudiendo a una intermediación fraudulenta, pero no explicó en modo alguno en qué circunstancias comprobadas de la causa basaba sus conclusiones. Señaló que omitió tener en cuenta la seria argumentación defensiva que planteaba que en las grandes empresas los miembros del directorio no pueden participar personalmente en las decisiones que se adoptan para la marcha ordinaria de los negocios, que solo les incumbe marcar las políticas de la compañía e instruir a la línea gerencial para que las ejecute y vele por su cumplimiento y que, por ende, no cabe exigirles una supervisión personal de cada contratación realizada sino el establecimiento de sistemas de auditoría y control apropiados. En esa línea, los jueces debieron examinar, mediante la compulsa de las pruebas contable y testifical, si el directorio efectivamente había delegado en la línea gerencial de la empresa la gestión de las contrataciones inherentes a la prestación de servicios personales y si, en tal caso, había establecido un sistema de control adecuado que hiciera probable prevenir o enmendar las irregularidades que la normativa laboral sanciona. Por último, el Tribunal agregó que la cámara también había omitido cotejar lo alegado en los planteos defensivos de los recurrentes en referencia al lapso durante el cual cada uno de los codemandados se desempeñó como miembro del directorio con la fecha de contratación del actor.
